1. DEFINITIONS
1.1. **Site Visitor** – an individual who visits the website 10motifs.com without the intent to place an order.
1.2. **User** – an individual, a visitor to the Site, who accepts the terms of this Public Offer and intends to place orders on the 10motifs online store.
1.3. **Buyer** – an individual who visits and/or registers on the website with the intention of ordering and/or purchasing a product, or an individual who has placed an order and/or made a purchase via the 10motifs online store.
1.4. **Seller** – UAB “10 motifs,” V. Nagevičiaus g.3, LT-08237 Vilnius, Lithuania, registration number 305768291.
1.5. **Online Store** – a website owned by the Seller, located at 10motifs.com, where information about Products offered for sale, as well as the terms and conditions for selection, ordering, payment, receipt, and return of Products by Buyers is provided.
1.6. **Product** – an object (clothing item, accessory, or other tangible item) presented for sale on the Site.
1.7. **Site** – 10motifs.com.
1.8. **Acceptance of Offer** – complete and unconditional acceptance by the Buyer of the terms of this Agreement.
1.9. **Order** – a properly submitted request by the Buyer for the purchase and receipt of Products selected on the Site.
2. GENERAL PROVISIONS
2.2. This Public Offer, along with the information about the product posted on the site, is a public offer. Acceptance of this offer (contract) is recognized as the Buyer placing an order for a Product in accordance with the terms of this offer.
2.3. This Public Offer contains all essential conditions for concluding a retail sale and purchase contract and is a public offer. The retail sale and purchase contract is considered concluded upon the completion of the following actions: issuance of a receipt or other document confirming payment by the Seller to the Buyer, and the transfer of the product to the customer.
2.4. By their actions directed at placing an Order and purchasing a Product, the Visitor/User/Buyer agrees to the terms of this Public Offer. If the Visitor/User disagrees with the terms of this Public Offer, they cannot place an Order or purchase a product on the Site, and must leave the Site. The contract entered into upon acceptance of this offer by the Buyer is an adhesion contract, which the Buyer joins without any exceptions and/or reservations.
2.5. The terms of this Public Offer may be unilaterally changed by the Seller by posting the new terms on the Site. New terms of the Public Offer become effective upon their posting on the Seller’s Site, unless otherwise specified by the rules being introduced. The terms of this public offer cannot be changed unilaterally by the Buyer.
2.6. Unless otherwise agreed upon between the Buyer and Seller, the relations between the specified parties shall be governed by the terms of this Public Offer and the legislation of the Republic of Lithuania to the extent not regulated by the provisions of this Public Offer. 2.7. By placing an Order on the Site, the User provides the Seller with their email and phone number, thereby consenting to the use of these communication methods by the Seller, as well as third parties engaged by the Seller to fulfill obligations to Users/Buyers, for the purpose of sending advertising and informational mailings containing information about discounts, upcoming and ongoing promotions, and other events of the Seller, the delivery of the Buyer’s Orders, as well as other information…
3. SUBJECT OF THE PUBLIC OFFER
3.1. The subject of this Public Offer is the provision by the Seller to the Visitor/User of the opportunity to purchase for personal, family, household, and other needs not related to business activities, the Products presented in the Online Store catalog at 10motifs.com.
4. WEBSITE REGISTRATION
4.1. Registration on the Site is done through the “Register” tab by entering the Buyer’s information into the registration form on the Site.
4.2. Registration on the Site is mandatory for placing an Order.
4.3. The Seller is not responsible for the accuracy and correctness of the information provided by the User during registration.
4.4. The User agrees not to disclose their login and password, specified during registration, to third parties. The Buyer is independently responsible for any possible negative consequences if they disclose their login and password to third parties. If the User suspects the security of their login and password or the possibility of unauthorized use by third parties, the Buyer agrees to immediately notify the Seller by sending an email to: [email protected].
4.5. Communication between the User/Buyer and Call Center operators/managers and other Seller representatives should be based on generally accepted principles of morality and communication etiquette. The use of foul language, abusive expressions, threats, or blackmail is strictly prohibited, regardless of the form and to whom they are addressed.
5. GOODS AND PURCHASE PROCEDURE
5.1. The Buyer places an Order for a Product in accordance with the procedures specified on the Site or with the help of a customer service specialist.
5.2. If the Products ordered by the Buyer are not available in the Seller’s warehouse, the latter has the right to exclude the unavailable Product from the Order and/or cancel the Buyer’s Order if all the Products ordered by the Buyer are unavailable. The Seller notifies the Buyer of the exclusion of the unavailable Product from the Order and/or cancellation of the Order as per the terms of this clause by sending an email to the address provided by the Buyer during registration on the Site and/o…
5.3. If a Product unavailable in the Seller’s warehouse is excluded from the Buyer’s Order and/or the Order is canceled as per clause 5.2 of this Public Offer, funds paid by the Buyer for the excluded Product and/or canceled Order shall be refunded to the Buyer in the manner in which the Product was paid or by other means at the Seller’s discretion, in accordance with this Public Offer.
5.4. After placing an Order on the Site, a customer service specialist servicing the Order contacts the Buyer by phone to confirm the Order details, coordinate the available delivery date and method, available payment method for the Product, and provides additional information upon the Buyer’s request within the scope of this Public Offer.
5.5. The Buyer is fully responsible for providing incorrect information that has resulted in the Seller’s inability to fulfill its obligations properly. Each Party guarantees to the other that it has the corresponding rights and sufficient capacity, as well as all other rights and powers necessary to conclude and execute this Agreement.
6. PAYMENT OF GOODS
6.1. A technical error is defined as an incorrect transfer of data from the Price Lists to the Seller’s website in the product listing, resulting from automatic data transfer. If the Seller identifies a technical error (e.g., an incorrect price for the ordered Product), they will promptly inform the Buyer via email and/or phone, offering the Product at the corrected price. If the Buyer refuses to purchase the Product at the corrected price or fails to respond within one working day, the order is canceled.
6.2. The Seller may unilaterally change a Product’s price on the Site. However, the price for a Product already ordered by the Buyer cannot be changed, except in cases specified in clause 6.1 of this Public Offer.
6.3. An incorrect indication of the Product price and a price change are distinct concepts.
6.4. The Buyer may pay for the Product ordered from the Seller by one of the following methods:
- Prepayment by credit card via online payment;
- Cash or credit card payment at the pickup point.
6.5. Credit card transactions must be performed by the cardholder.
7. RESPONSIBILITY
7.1. The Seller is not responsible for any damage caused to the Buyer due to improper use of Products purchased in the Online Store.
8. VALIDITY PERIOD OF THE PUBLIC OFFER
8.1. This Public Offer becomes effective upon the Buyer’s acceptance in accordance with clause 2.3 of this Public Offer and remains valid until the Public Offer is withdrawn. The Offer (Agreement) may be revoked by the Seller at any time, but such revocation does not affect the validity of obligations already undertaken by the Seller toward the Buyer.
